Carmen Tang

Senior Partner / Dispute Resolution

Carmen is Senior Partner of Chak & Associates LLP.

 

She has been practising law in Hong Kong for over 17 years, during which she has worked in both the private and public sectors, including the Office of the Privacy Commissioner for Personal Data, Hong Kong and the Law Society of Hong Kong.
 

Qualifying in Hong Kong in 2004 and England and Wales, she started her legal career working as a commercial litigator.

Carmen’s skills as a litigator led to a call from the Privacy Commissioner for Personal Data and, in 2010, she was appointed as Legal Counsel with responsibility for providing legal advice on personal data protection issues arising from complaints or compliance checks. She also advised government organisations on data privacy issues, and vetted proposed legislations.  In 2012, she expanded her legal expertise further when she became Investigation Counsel for the Law Society of Hong Kong, leading probes into alleged professional misconduct cases for the Compliance Department.

After five years as regulatory counsel, in 2017 Carmen returned to private practice, specializing in both Dispute Resolution and Data Privacy.

 

Carmen’s practice focuses on commercial litigation (in particular complex shareholder and partnership disputes for a wide range of clients) and regulatory investigations.  She regularly advises clients and represents their interests in investigations by Independent Commission Against Corruption (ICAC), Immigration Department, Privacy Commissioner for Personal Data and the police, involving cases of criminal, civil or disciplinary nature.  Her work also involves provision of legal advice and assistance on professional negligence claims and misconduct complaints.

 

Carmen also has a particular interest in data protection, working with clients to devise bespoke solutions on information security and privacy management matters.  She regularly advises clients on data privacy compliance requirements in Hong Kong and also issues in response to data breaches.

Apart from private practice, Carmen is a CEDR accredited Mediator and a member of the International Association of Privacy Professionals (IAPP). She is also IAPP’s ANSI/ISO-accredited Certified Information Privacy Professional / Asia (CIPP/A), Certified Information Privacy Professional / Europe (CIPP/E) and Certified Information Privacy Manager (CIPM).   She is one of the authors of Lexis Advance® Hong Kong Practical Guidance on Data Protection and one of the reviewers of LexisNexis Regulatory Compliance Modules (Cybersecurity and Anti-Bribery and Corruption)

 

Carmen is one of the Practising Solicitor Members of the Solicitors Disciplinary Tribunal Panel.
